Many of us have been involved in a car accident. Most accidents are not life threatening nor are they severe enough to cause major injury, medical issues or lost time on the job. However, there may be other issues such as being determined to be more than “50% at fault” and thus subject to a loss of driver merit points which may eventually lead to a large insurance surcharge. A seemingly minor matter such as this is a possible legal representation issue. An attorney will determine if you have a case and determine a course of action. Often times such cases may be handled on a contingency basis. According to Attorney Steve Whitman of Boston who specializes in personal injury and more commonly , auto accident cases, a person in an auto accident should seek immediate medical assistance to have a record of the event and determine if there may be current or the future potential for physical problems. Afterwards, a phone call to a law office to determine the viability of a legal case is a good approach. Knowing your rights is always best and a phone call to a law office that specializes in such matters and has probably handled thousands of such cases, is a quick and easy way to determine if a next step is necessary. Your peace of mind will definitely be increased through these actions.

I understand that the majority of auto accident cases are settled out of court. How long is it before this typically happens and how much more would a client receive vs taking the insurance company’s original offer ? Do you find that insurance companies are more likely to settle in this economic environment ?

  2. Depends on the case ! Many cases are backlogged in the courts and insurance companies. It can be settled within 12 months or with continuances 2 years or more. The award amount again will vary depending upon the facts of the case. As far as the economy goes, it makes little difference in my experience. I hope this helps. Be certain to seek the counsel of an experienced attorney for your particular case. One experienced in your area and the local courts is your best bet !
